Bee or fly?

Hi Please help to identified this looks like fly creature I don't think they're dangerous they never go buzz or sting when me n my little one walk pass them. But they have make a nest under the pavement right before a metre's high stairs which led to our garden and I'm worry my little one might get distracted to shooes them away while walking down the steps.
Thank you

They're Mason Bees - they don't sting or do any damage and they're really good to have around the garden for pollinating etc. Encourage your little one not to be afraid, and to watch them from a distance so as not to disturb them.

You might even like to get or make a bee hotel for them http://solitarybee.com/
It looks like a solitary bee that makes a nest in the soil. It will be gone in a couple of weeks after it has laid its eggs for next years bees. Dont worry. Unless you actually tread on it, it is unlikely to sting.
ahhh dats a relief..... I think they are quite shy it took me ages to get really up close to take those pics. and I almost drowned them with my water pipe just next to their nesting, prob the water lying around attract them to the spot.
yeap friends we are then.
