how to tidy up this 'tree'?

Hi
not sure what's the name of the green tree but i'm sure experiance gardeners here could jz tell by a glance.
It's going quite wild now as we dont know how to trim it or cut it down to properly shape it so it actually destroying our neighbour's fence.
Please help and give us some suggestion or advise. thank you
p/s:I wont wanna cut it too much as i know it has been housing some birds deep in the center.

Looks like Leylandii. Planted far, far too close to the wall and fence. Get Rid!!
Or it could be the slower growing lawsons cypress. Either way, you can trim them to shape so long as you don't cut back into brown wood. If you trim back any lanky shoots now it will stay neat until spring . It will not resprout from brown wood.
Whatever it is it's in the wrong place and will undermine both the wall and the fence.
To get rid, cut off about 3 ft from ground to give you something to lever on as you dig around the roots. This is a forest tree and could grow to 150 ft. It won't like being pruned so get rid, as others have said and treat yourself to a nice smallish shrub.
I had nearly 30 of those in my garden when I moved in. They seed themselves everywhere if you let me and suck all the life out of your soil. Left to grow naturally they can be beautiful trees but they need space. I don't think that one has that. Unless you are eager for the privacy I would get rid of it. If you leave roots or a stump in it won't grow back, but you'll be happier if you can get the stump out too so leave some trunk there to act as a handle for whoever pulls it out as wonderboy says. Get something that will work harder, ie with flowers, fruit, scent etc.
thank you for all kind and useful information. yes i have started to cut some sml branches down will do more in the weekend with a proper saw. The mess is much terrible as i thought when the outer layer is gone, the lower branch is almost being 'gravity' and grow towards the field which putting lots of weight on the stone barrier. so need it down asap too.
Just one more thing to ask for suggestion-- is there a quick way to stay privacy screen out from main road's street light /public view but still get some sunshine at day time to my flower plot? --as you can see from the pic below jz in front of the tree, also there are 2 big nice tree nx door blocked the sunshine for half of the day at this time of the year
