Hi AndB, lots of people confuse Deadly Nightshade with Woody Nighshade. There are a few posts on the forum where the Deadly turns out to be Woody, and since Deadly Nightshade is a relatively rare plant of chalkland I would guess you don't have it.
As Panda says, the picture didn't come through, so it would be nice if you could try to upload one again.

It is Woody Nightshade, Solanum Dulcamara, aka Bittersweet.
The berries are bitter, unpleasant to taste and are toxic if eaten in great quantities.

With young children around though, maybe you should consider removing it.
It is a pesky weed. It seeds everywhere.
