Fence colour

What ho one and all,

X years ago, my neighbour, with whom we are friendly, replaced a section of his failing fence with a new one, but it is that kinda rust red.  At the time, I asked him if we could paint it a colour that we liked, and he would not agree.

The fence is still in great condition but weathered and again, I would like to paint it a mid-gray.  I have yet to seek his permission so obviously, don't know his response.

But given that he never sees our side of his fence, am I within my rights to paint it without his permission?  After all, it would be doing him a favour in maintaining his fence.

    The trouble is, the paint can leak through the slats and looks awful on the other side which would mean he'd probably have to paint his side too.

    if it's HIS fence, you have no right to paint it, or attach anything to it without his permission. 
    Doing so could be considered " causing criminal damage " 
    Please don't.
